Hungarian constitutional reform and participation debates

Hungary’s constitutional reform process has seen intensifying debates regarding the balance between parliamentary authority and societal involvement. While a parliamentary mandate is established through elections, experts argue that this should not preclude broader participation. There is a growing consensus among commentators that involving civil society and specialists is essential to prevent the constitution from becoming a mere compromise between political elites.

Discussions have expanded to include the nature of the current political landscape, with debates over whether the country is experiencing a standard democratic government change or a radical systemic shift. To maintain democratic integrity, experts suggest the need for moderation, constructive dialogue, and clarified procedural steps. While referendums have been proposed to validate fundamental questions, concerns persist regarding the efficiency of conducting multiple separate votes.

Recent discourse has also focused on the legitimacy of the reform process and judicial appointments. Legal sociologist Zoltán Fleck noted that the current period serves as a transition phase to address institutional remnants of the previous era. Fleck described the current structure as ‘truncated parliamentarism’ but noted that the Tisza Party has nominated candidates viewed as professionally excellent and free from bias. To ensure long-term democratic legitimacy, proposals include moving beyond mere public opinion polling toward a true dialogue where citizens access expert information. Suggested structural improvements include involving professional organizations and creating parity-based parliamentary committees to oversee the selection of constitutional court judges.
