India hospital billing and facility transparency mandates

Overview

The Indian Union Health Ministry directed states and Union Territories to enforce transparency regarding hospital service and facility rates. Under the Clinical Establishments Act of 2010, registered facilities are required to display charges in English and local languages to assist with medical expenditure planning and reduce billing disputes. The directive also includes provisions for displaying treatment package rates for foreign patients.

Following this guidance, individual states have begun implementing specific mandates. Maharashtra ordered private hospitals to display service charge lists in both Marathi and English at prominent locations like entrances and reception counters. In West Bengal, the health department ordered both government and private hospitals to display the availability of Intensive Care Unit (ICU) beds, categorized into three levels based on equipment, staffing, and patient space, in accordance with a Supreme Court mandate.
