India-UN diplomatic dispute over human rights reports

Overview

India has formally rejected a report by United Nations Special Rapporteur Gina Romero regarding the rights to freedom of peaceful assembly and association. During the 81st session of the UN General Assembly’s Third Committee, Indian diplomat Anuj Swarup criticized the findings, which alleged that Indian youth face retaliation or stigmatization for discussing mental health and gender justice.

Swarup dismissed the report as “hearsay dressed up as a report,” arguing that it relied on “anonymous and unverified submissions” rather than concrete evidence. He warned that such “arbitrary report writing” causes the United Nations to lose credibility.

In defense of domestic policies, Swarup stated that the Indian Constitution guarantees freedoms of speech, expression, assembly, and association, protected by an independent judiciary, a free press, and the National Human Rights Commission. He also cited government initiatives, such as the Viksit Bharat Young Leaders Dialogue, as evidence of engagement with the nation's youth. Additionally, Swarup accused Human Rights Commissioner Volker Turk of maintaining double standards regarding responses to protests in various regions.
