Indian statutory bonus regulation and employee demands

Overview

Central government employee organizations, led by the National Council Staff Side Joint Consultative Machinery (NC-JCM), requested an increase in the calculation ceiling for the annual Non-Productivity Linked Bonus. The group proposed raising the current ₹7,000 monthly salary limit to between ₹18,000 and ₹21,000 to better align with minimum wage standards.

Following these developments, the Ministry of Labour and Employment issued notifications under the Code on Wages, 2019. The new regulations mandate statutory bonuses for employees earning up to ₹21,000 per month, provided they have worked at least 30 days in the accounting year. Under Section 39(1) of the Code, bonus amounts must be between 8.33% and 20% of either ₹7,000 or the applicable minimum wage, whichever is higher, and must be deposited into employee bank accounts within eight months of the year's end.
