Indian Supreme Court legal stays
Overview
The Supreme Court of India stayed an Allahabad High Court order involving two advocates, Shiv Kant Mishra and Krishna Kant Mishra. The High Court had previously directed the Registrar General to initiate criminal and disciplinary proceedings under Section 340 of the CrPC, alleging the lawyers used a “fabricated copy of a land acquisition award” to secure interest payments for clients in a dispute with the Bareilly Development Authority.
The High Court had also sought to cancel the advocates’ licenses through the Bar Council of India and the state Bar Council. The Supreme Court has issued a notice regarding the special leave petition and scheduled a hearing for October 12.
