Indonesian legal debate over corruption definitions
Overview
Indonesian Coordinating Minister for Law, Human Rights, Immigration, and Correctional Affairs, Yusril Ihza Mahendra, has called for greater legal certainty regarding the distinction between criminal corruption and business losses within State-Owned Enterprises (BUMN). Mahendra argued that business investments carry inherent risks and that losses should not automatically trigger corruption investigations without evidence of wrongdoing. He also noted that the current definition of state finances is inconsistent across 23 different laws.
Following these remarks, President Prabowo Subianto met with Mahendra to discuss a proposal by the National Economic Council (DEN) to revise the definitions of corruption found in Law Number 31 of 1999 and Law Number 20 of 2001. While the President has not yet approved these changes, he has requested an in-depth study to ensure any new definition aligns with the current national context. The discussions included clarifications on the United Nations Convention Against Corruption (UNCAC), with Mahendra noting that while UNCAC provides international guidance on issues like money laundering and fraud, individual nations retain the ability to formulate their own specific legal definitions.
