Overview

Representing the communities, the Native Federation of the Madre de Dios River and Tributaries (FENAMAD) and EarthRights International allege that Peru failed to protect ancestral territories from extractive industries, including logging, mining, road construction, oil exploration, and drug trafficking. Claimants argue that these activities contribute to forest fragmentation and increase the risk of violent encounters and the transmission of infectious diseases to populations with little immunity.
During the hearings, Indigenous leaders demanded that the state uphold the principle of non-contact and ensure the integrity of ancestral territories. They noted that although Peru recognized the existence of these isolated peoples in 2006, the process to expand and recategorize their reserve areas remains unfinished. Leaders argued that this lack of legal certainty has allowed illegal logging and extractive activities to invade their lands, threatening their survival and right to self-determination.
While Peru maintains it has implemented laws and monitoring systems to protect these groups, advocates argue these protections are not enforced in practice. The court’s decision may establish international responsibility for Peru and set new standards for the protection of isolated Indigenous peoples.
