The Italian Supreme Court (Cassazione) has issued rulings addressing employer authority and employee rights in the workplace.
In one instance, the Court ruled that employers cannot use GPS data, Telepass records, or private investigators to monitor a worker’s routine performance. This decision followed the dismissal of a waste collection driver who was tracked via GPS and private detectives for taking unauthorized breaks; the Court deemed these controls illegitimate for verifying job performance, resulting in the worker’s reinstatement and compensation.
In a separate ruling, the Court upheld the dismissal of an employee who refused to wear a mask. While the national state of emergency had concluded, the Court found that internal safety protocols agreed upon with worker representatives remained valid. The judges noted that under Article 2087 of the Civil Code, employers are required to implement measures to protect the physical integrity and moral personality of their employees.
