Jalisco judicial ruling on crime apology laws
Overview
The Supreme Court of Justice of the Nation (SCJN) invalidated specific language in Jalisco laws concerning the apology of ‘vices’, ruling the term too ambiguous to justify criminal penalties. This decision followed an unconstitutionality action filed by the National Human Rights Commission (CNDH) against a decree from the Jalisco Congress.
In response, the Government of Jalisco clarified that sanctions for the apology of crimes remain in effect. While the Court struck down references to ‘vices’ to prevent arbitrary moral judgments, it did not invalidate provisions penalizing the public incitement to commit crimes or the glorification of criminal conduct. Consequently, the state retains the ability to regulate content, such as narcocorridos, provided it meets legal criteria for glorifying criminal acts. Local municipalities must also continue to issue regulations regarding music and video content that promotes violence or exalts criminals during public spectacles.
