Overview

Authorities in Japan have begun implementing stricter legal standards for traffic offenses following recent amendments to the Automobile Driver Punishment Act.

In early August, arrests were reported in Fukuoka and Toyama Prefectures involving drunk driving and dangerous driving causing death. In Toyama, the application of the revised act marked the first time the prefecture used the new standards based on specific blood alcohol concentrations to address dangerous driving.

By mid-August, the Osaka District Public Prosecutors Office indicted a 22-year-old man for dangerous driving resulting in death following a fatal July accident on the Hanshin Expressway. The defendant was allegedly driving under the influence at approximately 160 km/h in a 60 km/h zone. This case represents the first time in Japan that the new legal thresholds for excessive speeding have been applied to upgrade charges from negligent driving to dangerous driving.
