Judicial disciplinary actions in Peru
Overview
The Peruvian judiciary has seen recent disciplinary actions and legal challenges involving high-profile magistrates.
On September 18, 2026, the National Board of Justice (JNJ) dismissed judge Richard Concepción Carhuancho following a disciplinary procedure. The decision, approved by a majority vote, was based on delays in notifying a resolution and processing an appeal in the ‘Los Waykis en la Sombra’ case. The Constitutional Court had previously ruled that these delays violated a defendant's rights to defense and plurality of instance. Carhuancho is a prominent magistrate known for presiding over major investigations, including the Odebrecht case, and having ordered preventive detention for several political figures, including Keiko Fujimori, Alejandro Toledo, and Ollanta Humala.
In a separate development, the Peruvian Third National Criminal Appeals Court ordered the definitive archiving of the criminal case against former president Pedro Pablo Kuczynski. The investigation involved alleged irregular campaign contributions and aggravated money laundering during his 2016 election. The court determined, applying Constitutional Court criteria, that the alleged actions were not criminalized under the specific legislation in effect at the time of the campaign.
Additionally, Judge José Leonel Matos Centeno left his post at the Pampas-Tayacaja Preparatory Investigation Court following the revocation of a preventive detention order against eight military personnel. The First Criminal Appeals Court of Junín overturned the detention due to deficiencies in legal reasoning. Matos Centeno faces a complaint filed with the JNJ by Senator Fernando Rospigliosi and criminal charges from defense lawyers for alleged prevarication and ideological falsehood.
