Kenyan legal disputes over abduction victim compensation

Overview

Legal proceedings in Kenya have focused on the rights of victims of abductions, torture, and enforced disappearances regarding both individual disappearance cases and access to government compensation.

Initially, the Nairobi High Court postponed a decision regarding the disappearance of Abdulaziz Zizou to allow oversight bodies, such as the Independent Policing Oversight Authority (IPOA), to intervene. Simultaneously, victims petitioned the court to challenge their exclusion from a government compensation programme, arguing that new verification processes under Presidential Proclamation No. 1 of 2026 were unconstitutional.

Following these petitions, a High Court judge issued conservatory orders to halt the implementation of the new authentication process used to verify beneficiaries. The court ordered that Ksh105 million be set aside from the compensation fund specifically for victims of torture and abductions to ensure they are not disadvantaged while the legal dispute over the verification framework is resolved.
