Kenyan police custody death and accountability measures
Overview
The death of nineteen-year-old Erick Otieno in Nairobi has prompted investigations into police conduct. Otieno, a boda-boda rider, died at Mama Margaret Uhuru Hospital following his detention at Muthaiga Police Station. A post-mortem examination conducted on 4 August revealed internal bleeding and a ruptured spleen resulting from blunt-force trauma. While the Directorate of Criminal Investigations began inquiries, the Independent Policing Oversight Authority has since taken over the probe. Otieno’s family alleges that police assaulted him and denied him medical treatment.
In response to such incidents, the National Police Service (NPS) has outlined new protocols for deaths in custody. Following a directive from Inspector General Douglas Kanja, the NPS stated that officers on duty during such incidents—including the cell sentry, the duty officer, and the Occurrence Book recorder—will face immediate interdiction. These measures aim to maintain public trust and prevent the tampering of evidence while investigations proceed through legal and internal disciplinary channels.
