Legal and political challenges for Rahul Gandhi

Overview

The Supreme Court of India has issued a stay on trial court proceedings in a criminal defamation case against Congress leader and Leader of the Opposition, Rahul Gandhi. The case stems from remarks made during the 2018 Rafale controversy, in which Gandhi allegedly referred to Prime Minister Narendra Modi as ‘Choro Ke Sardar’ and ‘Commander-in-Thief’.

The Supreme Court bench issued notices to the Maharashtra government and the original complainant, BJP worker Mahesh Shrishrimal, requesting responses within four weeks. This follows a September 8 ruling by the Bombay High Court that refused to quash the defamation summons. While Gandhi’s legal team argues the complaint is not maintainable because his remarks did not name a specific group, the complainant alleges the comments effectively defamed the BJP.

In addition to the legal proceedings, Gandhi has faced political backlash. The BJP has accused him of attempting to destabilize constitutional institutions following his efforts to meet the Chief Justice of India regarding alleged election irregularities. Furthermore, the DMK party in Tamil Nadu has distanced itself from Gandhi, criticizing his recent comments on Tamil culture and history.
