ChangXin Memory Technologies (CXMT) is facing legal and regulatory challenges regarding its technology and its relationship with the Chinese military.

In South Korea, a former Samsung Electronics engineer testified in court that CXMT utilized stolen intellectual property to develop its DRAM technology. Concurrently, CXMT has filed a lawsuit in the U.S. District Court for the District of Columbia against the U.S. Department of Defense to overturn its designation as a ‘Chinese military company’ under Section 1260H. The company argues the designation is “arbitrary,” lacks evidence, and violates due-process rights, maintaining that its DRAM chips are intended for civilian and commercial use in devices like smartphones and AI systems.

CXMT notes the designation was applied in January 2025 and maintained through a June 2026 update. The company highlighted a specific incident in February 2026, where the Pentagon issued a notice suggesting CXMT would be removed from the list, only to retract that notice on the same day without explanation. The lawsuit names Defense Secretary Pete Hegseth, Deputy Defense Secretary Steve Feinberg, and Assistant Secretary of Defense for Industrial Base Policy Michael Cadenazzi as defendants.
