ChangXin Memory Technologies (CXMT) is facing legal and regulatory challenges regarding its technology and its relationship with the Chinese military. In South Korea, a former Samsung Electronics engineer testified in court that CXMT utilized stolen intellectual property to develop its DRAM technology. The testimony alleged that CXMT executives intended to use Samsung’s ‘Process Recipe Plan’ to establish manufacturing capabilities. This included the theft of 600 manufacturing steps and critical equipment conditions for 18nm-class DRAM processes. While CXMT is reportedly making technical progress in High-k metal gate technology and sampling HBM3 products, it remains approximately two generations behind industry leaders in High Bandwidth Memory technology. Concurrently, CXMT has filed a lawsuit against the U.S. Department of Defense in the U.S. District Court for the District of Columbia. The company is challenging Columbia against the U.S. Department of Defense to overturn its designation on the as a ‘Chinese military company’ under Section 1260H list, which identifies entities believed to operate in support of the Chinese military. The company argues the designation is “arbitrary,” lacks evidence, and violates due-process rights, maintaining that its DRAM chips are intended for civilian and commercial use. use in devices like smartphones and AI systems. CXMT notes the designation was applied in January 2025 and maintained through a June 2026 update. The company highlighted a specific incident in February 2026, where the Pentagon issued a notice suggesting CXMT would be removed from the list, only to retract that notice on the same day without explanation. The lawsuit names Defense Secretary Pete Hegseth, Deputy Defense Secretary Steve Feinberg, and Assistant Secretary of Defense for Industrial Base Policy Michael Cadenazzi as defendants.
