Legal challenges to Kansas Senate Bill 244

Kansas Senate Bill 244, passed in early 2026, has become the subject of legal challenges regarding its impact on transgender residents. The law prohibits transgender individuals from using public restrooms on government property that align with their gender identity and permits private lawsuits against suspected violators.

Furthermore, the legislation invalidates state-issued driver’s licenses that feature gender markers reflecting an individual’s gender identity. In response, the American Civil Liberties Union and the ACLU of Kansas filed a lawsuit alleging the law violates state constitutional rights to privacy, equality, and personal autonomy.

In a specific ruling, a Douglas County District Judge reinstated the driving privileges of a transgender resident, Jamie Miller, after her license was invalidated under the law. Judge James McCabria ruled that the Kansas Department of Revenue likely violated Miller’s right to due process due to “confusing and contradictory instructions” regarding license invalidation and appeal processes. While the ruling restored Miller’s ability to drive, it did not rule on the legality of the gender marker requirement itself.
