Legal challenges to Supreme Court of India procedures
Overview
The Supreme Court of India is facing scrutiny regarding judicial conduct and procedural integrity. Legal challenges have emerged concerning former Justice Yashwant Varma, following a Lok Sabha enquiry report that found charges related to a cash-at-home controversy to be proved. While Varma resigned in April, petitions seeking a First Information Report (FIR) or a CBI probe have previously been dismissed by the Supreme Court and the Delhi High Court.
Concurrently, the Lawyers Association for Constitution (LAFC) has raised concerns regarding the listing of petitions filed by Noida District Magistrate Medha Roopam. The LAFC questioned why these matters, which challenge an Allahabad High Court order regarding a student's detention under the National Security Act, were “specially assigned to a particular bench” in violation of protocols. The association suggested the proceedings gave an appearance of ‘special treatment’ due to Roopam’s status as the daughter of Chief Election Commissioner Gyanesh Kumar, citing restricted media access and muted audio during video-conferencing.
The Supreme Court has since clarified that its current stay applies to strictures against Roopam and a compensation order, rather than the quashing of the student's detention.
