Former South Korean President Yoon Suk Yeol continues to face various legal proceedings involving election, political fund, and graft allegations. In a significant development regarding the Political Funds Act, the Seoul High Court has acquitted Yoon and political broker Myung Tae-kyun. This appellate ruling reverses a lower court's decision that had found Yoon guilty of 14 instances of receiving free opinion polls and sentenced him to two years in prison. The prosecution had argued that Yoon and his wife, Kim Keon-hee, conspired to receive approximately 270 million won worth of 58 free polls from Myung. However, the appellate court ruled there was no evidence of an agreement or consensus between the parties to provide the polls for free, stating it was “difficult to recognize an intent to donate political funds.” Kim Keon-hee had previously been found not guilty in both the first and second trials, with courts determining Myung provided the polls unilaterally to expand his own influence. Regarding perjury allegations, the Seoul High Court has upheld an acquittal for Yoon. The prosecution had argued that Yoon provided false testimony during the insurrection trial of former Prime Minister Han Duck-soo regarding his intentions to convene a cabinet meeting for declaring emergency martial law. Despite this, the special prosecution team led by Cho Eun-seok has appealed this acquittal to the Seoul High Court. Additionally, the Seoul Central District Prosecutors' Office has indicted Yoon for violating the Improper Solicitation and Graft Act concerning luxury goods received by Kim Keon-hee. Separately, prosecutors decided not to indict Yoon for violating the Public Official Election Act regarding statements about Kim Keon-hee’s Deutsche Motors stock trading. In a separate legal challenge, a special prosecutor has requested that the Seoul High Court uphold a first-instance sentence for Yoon regarding violations of the Public Official Election Act.
