Serrano’s defense has filed an appeal with the Audiencia Nacional to nullify the seizure and cloning, seeking the destruction or permanent neutralization of the data copies. The defense argues that the initial May 27 seizure was unauthorized and that the subsequent cloning data extraction performed in August, even though conducted in the presence of his lawyer, cannot cure rectify the initial violation of legal guarantees. They have also raised concerns regarding the chain of custody, suggesting the device remained under police supervision for approximately one and a half months an extended period without external oversight, potentially allowing for undocumented access or data manipulation. While Serrano has requested the return of his iPhone 15 Pro Max, investigators continue to process over 250 GB of data to determine its relevance to the ‘Caso Leire’ investigation.
