Leire Díez judicial investigation in Spain

Overview

The Leire Díez investigation, led by Judge Santiago Pedraz, examines an alleged network rigging public contracts for the Spanish Society of Industrial Participations (SEPI) and a suspected plot to obstruct judicial processes affecting the PSOE and the Spanish Government. Investigators have identified Leire Díez as a coordinator of these activities and have pointed to Santos Cerdán, former Secretary of Organization for the PSOE, as a leader in both branches.

Juan Manuel Serrano, the former chief of staff to Pedro Sánchez and former president of Correos, has been formally implicated due to his alleged ‘preeminent role’. Following legal challenges regarding the legality of his phone seizure, Judge Pedraz ordered the cloning of his mobile device. The Central Operative Unit (UCO) of the Guardia Civil has completed the process, producing a ‘raw dump’ for the Audiencia Nacional and a ‘processed copy’ for analysis.

Serrano’s defense has filed an appeal with the Audiencia Nacional to nullify the seizure and cloning, seeking the destruction or permanent neutralization of the data copies. The defense argues that the initial May 27 seizure was unauthorized and that the subsequent data extraction performed in August, even though conducted in the presence of his lawyer, cannot rectify the initial violation of legal guarantees. They have also raised concerns regarding the chain of custody, suggesting the device remained under police supervision for an extended period without external oversight, potentially allowing for undocumented access or data manipulation. While Serrano has requested the return of his iPhone 15 Pro Max, investigators continue to process over 250 GB of data to determine its relevance to the ‘Caso Leire’ investigation.
