Lithuanian parental labor rights and legislative updates

As the September 1 school year approaches in Lithuania, discussions have focused on parental rights and labor code entitlements for working parents.

Initial reports highlighted that employees raising children under 14 enrolled in pre-school, primary, or basic education are entitled to at least half a working day off on the first day of school, provided they do not already have designated ‘mother’s day’ or ‘father’s day’. Other entitlements include varying amounts of additional rest days based on the number of children or children with disabilities. Eglė Tamavičiūtė, a senior lawyer at COBALT, noted that parents who have already used their designated parental day must negotiate unpaid or annual leave with employers.

Following these reports, the State Labour Inspectorate (VDI) provided formal clarification. VDI Chancellor Šarūnas Orlavičius specified that the paid half-day is not an additional guarantee to be used alongside existing parental rest days. Employees who already possess a ‘mother’s day’ or ‘father’s day’ cannot claim the paid half-day and must instead use their designated rest day. For those ineligible for the paid half-day, the VDI recommends negotiating unpaid leave, noting that employers must provide unpaid leave upon request for employees raising children under 14 in accordance with the Labor Code.

In a significant legislative development, the Lithuanian Seimas passed amendments to the Labor Code to extend these benefits. Starting January 1, 2027, additional rest days will be available to employees raising children up to 14 years of age, increasing the previous limit of 12. The amendments also extend benefits to legal guardians and professional military personnel. While proponents argue the change supports family-friendly policies and reduces burnout, critics have raised concerns regarding the economic burden on businesses and the public sector.
