Massachusetts legislative and ballot initiatives
Overview
Massachusetts is facing several significant legislative and voter-driven decisions regarding public safety, substance regulation, and housing.
Voters have addressed Question 9, a referendum to repeal ‘An Act Modernizing Firearm Laws’. This 2024 legislation introduced regulations on ‘ghost guns’, expanded definitions for ‘assault-style firearms’, mandatory firearm registration, and expanded ‘red flag’ provisions. Following the November 3 election, voters approved Question 9, rejecting the attempt to repeal the 2024 gun safety law.
In the realm of cannabis regulation, the Massachusetts Cannabis Control Commission is evaluating a proposal to allow out-of-state patients to access the medical cannabis program by removing residency requirements. Regarding recreational marijuana, voters have now overwhelmingly rejected Question 8, a ballot initiative that sought to repeal core elements of the state’s adult-use legalization laws. The measure would have eliminated the legal recreational market and prohibited home-growth. With 48 percent of ballots counted, approximately 76 percent of voters opposed the repeal. The initiative faced opposition from officials including Governor Maura Healey and Boston Mayor Michelle Wu, while the campaign to repeal was primarily funded by Smart Approaches to Marijuana (SAM).
Regarding housing, the results for Question 7, which seeks to legalize starter home zoning on lots as small as 5,000 square feet, remain too close to call. With over 49 percent of the vote counted, supporters held a narrow lead of 50.8 percent to 49.2 percent.
