Mexico artificial intelligence regulation efforts

Efforts to regulate artificial intelligence are emerging at both the regional judicial level and the national government level in Mexico.

In the State of Mexico, the Judiciary (PJEM) is addressing a significant shortage of judges while simultaneously implementing safeguards against the misuse of technology. Judicial officials have characterized the use of AI to dictate sentences as an “ethical fraud,” asserting that technology must not substitute human reasoning. To manage this, the PJEM is developing a regulated AI system to serve as a consultation tool, with a pilot program for labor law jurisdictions scheduled for December.

At the national level, President Claudia Sheinbaum has proposed a national debate regarding the regulation of AI and social media, specifically focusing on their impact during electoral processes. The initiative seeks to mitigate risks such as disinformation, digital content manipulation, and the use of automated bots to fabricate trends. The President emphasized that any framework must avoid becoming a tool for censorship, noting that the rapid evolution of digital tools, including personalized algorithms and paid political campaigns, has changed how citizens consume information.

As the electoral period has already commenced, Sheinbaum indicated she will consult with Legal Counsel Luisa María Alcalde to determine if the Congress of the Union can legally address these legislative changes at this time. The administration intends to study international experiences to establish rules that address digital manipulation without restricting freedom of expression.
