Mexico assisted death legalization debate

The debate regarding the legalization of assisted death in Mexico has moved from legislative proposals to public demonstrations. Initially, federal deputy Elena Edith Segura Trejo of the Morena party introduced an initiative to amend Article 4 of the Constitution. This proposal seeks to establish a constitutional right to assisted voluntary death for adults with incurable and irreversible illnesses, emphasizing that the State must guarantee access to palliative care and psychological support to ensure the procedure is not a result of poverty or lack of medical care.

Following this legislative move, activists and patients with incurable diseases organized the first ‘March for a Dignified Death’ in Mexico City. Led by Samara Martínez, the movement advocates for the ‘Ley Trasciende’ (Transcend Law), which aims to reform the General Health Law and the Penal Code to decriminalize and regulate medical assistance in dying. Protesters submitted initiatives supported by over 180,000 signatures to various levels of government.

In response to the growing discourse, the Ministry of Health inaugurated a national forum titled ‘Bioethics and Dignified Death’ to facilitate discussions among medical, ethical, and legal experts regarding patient autonomy and end-of-life care.

Following the recent march from Bellas Artes through the Historic Center, Mexico City Head of Government Clara Brugada met with movement representatives. Brugada expressed support for prioritizing the debate on the law during the current legislative period, and local legislators have received the proposal for analysis. While current Mexican law allows for advance directives to refuse life-prolonging treatments, active euthanasia remains prohibited under the existing legal framework.
