Mexico Profeco consumer protection enforcement
Overview
Mexico’s Federal Consumer Protection Agency (Profeco) has taken steps to enforce transparency and voluntary payment standards across various service sectors.
Initially, the agency announced that restaurants, bars, and cafes would face significant fines for attempting to make tipping mandatory. Under the Federal Consumer Protection Law, tipping is defined as a voluntary expression of gratitude. Violations can result in fines ranging from approximately 702 pesos to over 4.1 million pesos, as well as potential business closures of up to 90 days.
Following this, Profeco expanded its focus to the ticketing industry. Agency head Iván Escalante clarified that ticket sales companies must disclose all additional charges, such as taxes, commissions, or insurance, before a transaction is finalized. The agency has implemented guidelines for mass concert ticket sales to ensure that advertised prices are transparent and that any additional services remain optional and require explicit consumer consent.
