Mexico Supreme Court Mahahual development dispute

Mexico’s Supreme Court of Justice of the Nation (SCJN) has intervened in a legal dispute concerning urban development changes in Mahahual, Quintana Roo. The controversy involves modifications to the local Urban Development Program covering approximately 107 hectares, which were requested by companies linked to Royal Caribbean to facilitate the ‘Perfect Day’ water park project.

Local residents and the organization ‘Defendiendo el Derecho a un Medio Ambiente Sano’ (DMAS) have challenged these changes, arguing they were approved without proper public consultation and pose threats to mangroves and the coastal ecosystem. While the project reportedly no longer holds environmental authorization, the legal battle persists regarding territorial planning and land use regulations.

The SCJN is reviewing resources filed by residents to determine whether these modifications constitute a general norm or an administrative act. This distinction is critical for establishing the legal rules, timelines, and standing required for citizens to file injunctions (amparos) against such changes. The ruling is expected to set a precedent for environmental justice and urban planning litigation in Mexico.
