Misuse of Supreme Court of India judicial remarks

Reports have emerged regarding the alleged decontextualization of oral observations made by judges of the Supreme Court of India for political and social media exploitation.

In May 2026, Chief Justice Surya Kant used terms such as “cockroaches” and “parasites” to describe individuals entering professions using fraudulent law degrees. While the Chief Justice clarified the remarks targeted credential fraud, activists reportedly repurposed the comments to launch political movements. A subsequent instance in August 2026 involved remarks by Justice Dipankar Datta regarding MP Mahua Moitra, which critics claim were similarly stripped of context to suggest a judicial dismissal of her security concerns.

In response to these developments, the Supreme Court has issued notices to the Central Government, the Ministry of Electronics and Information Technology, the Bar Council of India, and the CBI following a Public Interest Litigation (PIL). The petition alleges that judicial remarks are being exploited for commercial and political purposes, specifically citing the social media campaigns surrounding the Chief Justice’s May remarks. The petition also seeks a CBI investigation into the underlying issue of fraudulent legal credentials. A hearing is scheduled for September 10, 2026.
