Nebraska online sports betting ballot initiatives

Overview

Nebraska is preparing for a November 2026 general election vote regarding the legalization of online sports wagering. The ballot will include two separate measures: a constitutional amendment to authorize online wagering and a regulatory initiative to establish a legal and tax framework. If both pass, racetrack casinos could offer online betting or partner with up to two sportsbook operators. Proponents, such as Tax Relief Nebraska, claim the move could generate $87 million in tax revenue over five years, with 70% of those funds directed toward property tax credits. Campaign funding for these initiatives includes approximately $3.5 million each from FanDuel and DraftKings.

The certification of these measures follows a criminal investigation into the petition drive led by Tax Relief Nebraska. While the group submitted over 201,000 signatures to exceed the 127,000 required, Lancaster County Election Commissioner Todd Wiltgen flagged more than 13,000 petitions as potentially fraudulent. Investigations indicated that approximately 68% of flagged petitions contained suspected fraudulent signatures, and over 20% involved individuals who may not be registered Nebraska voters. Several individuals have been arrested, with some facing felony election fraud charges. Despite these investigations, organizers maintain they are “very confident” that enough valid signatures remain to qualify the referendum for the ballot.
