New York City Mayor Zohran Mamdani has initiated legal action against the City Council to block the “Respect for Paraprofessionals” bill, also referred to as the RESPECT Check Act. The Mayor’s administration contends that the bill, estimated to cost $325 million, violates state collective bargaining rules under the Taylor Law. Officials argue that bypassing the formal negotiation process between the city and the United Federation of Teachers (UFT) sets a dangerous precedent. The administration stated its intent to ensure that “workers, rather than politicians, determine their own compensation through negotiation.”

While the Mayor previously expressed support for these pay increases during his campaign, he allowed the bill to lapse into law without his signature before seeking a court injunction on August 19.

In response to the lawsuit, the UFT has filed a motion to intervene. UFT President Michael Mulgrew stated that the union is prepared for legal action, maintaining that the law was “carefully drafted to comply with the Taylor Law” and would not have been passed if it threatened collective bargaining rights. Despite the litigation, the Mayor has characterized recent discussions with City Council Speaker Julie Menin and the UFT as “productive.”
