Overview

Nigeria’s Independent National Electoral Commission (INEC) has begun restoring several State House of Assembly constituencies following Supreme Court judgments. Initially, the commission focused on restoring three constituencies in Delta State: Isoko North Constituency II, Abraka State Constituency, and Ughelli South Constituency II. The Resident Electoral Commissioner described the process as a “constitutional obligation” intended to strengthen representative democracy.

By late August, the scope of restoration expanded to include the Yagba West II constituency in Kogi State. Elections for these restored areas are scheduled for September 19, 2026, with party primaries occurring in late August.

In a separate legal development, INEC is facing a lawsuit in the Federal High Court in Lagos regarding candidate substitution. A claimant, Hon. Tunde Pratt, alleges that his candidacy for the Lagos Mainland Federal Constituency was unlawfully replaced with another individual, a move he argues violates the Electoral Act.
