Ontario Special Investigations Unit findings

Overview

The Special Investigations Unit (SIU) has concluded two separate investigations into police conduct in Ontario.

In the first case, the SIU cleared the Northumberland Ontario Provincial Police (OPP) following the death of a 28-year-old man held in custody in Cobourg. The man died after experiencing a seizure and falling from a cell bench. SIU Director Joseph Martino stated there were “no reasonable grounds to believe that any police officer or custodian committed a criminal offence,” noting that officers responded with due care.

In a second investigation, the SIU cleared a Hamilton Police Service officer of charges following an arrest on June 20. The incident involved a 44-year-old man who used a crowbar to smash a police cruiser window. During the subsequent struggle, the officer mistook the crowbar for a knife and used knee strikes and punches to control the suspect. Director Martino determined the use of force was “legally justified,” as the officer had cause to fear for public safety.
