The Philippine Senate impeachment court has finalized a procedural shift regarding the voting threshold required to convict Vice President Sara Duterte. In a 13-1 vote, the court overturned the previous requirement of a fixed 16 votes, ruling that the two-thirds constitutional mandate should be calculated based on the number of senator-judges legally and factually capable of participating. With the voting base effectively reduced from 24 to 20 eligible members, the number of votes required for a conviction has dropped to 14. Senate President Pro-Tempore Francis “Chiz” Escudero cast the sole dissenting vote. This decision has prompted the impeachment court to request that the Supreme Court quickly resolve the resulting legal challenges to prevent the verdict from being “left in limbo,” according to court spokesperson Reginald Tongol. Two specific petitions are currently before the high court: one filed by former Executive Secretary Victor Rodriguez, which argues the ruling “unlawfully rewrites the 1987 Constitution,” and another by lawyer Ernesto Francisco Jr., seeking a status quo ante order to halt the new rule’s implementation. Adding to the legal pressure, Senators Robin Padilla and Bong Go, alongside PDP-Laban, have filed a Petition for Certiorari and Prohibition. The petitioners seek to restore the 16-vote requirement, arguing the Constitution explicitly requires the concurrence of “two-thirds of all the Members of the Senate.” They contend that because no Senate seats have been vacated, the threshold must remain 16 regardless of whether individual senators are absent or ill. They have requested the Supreme Court issue a Status Quo Ante Order, a Temporary Restraining Order, and a Writ of Preliminary Injunction while the petition is considered. As the legal dispute continues, Senate President Sherwin Gatchalian indicated that a revised trial calendar could potentially allow for a final vote by December.
