District inspectors determine the existence of an employment relationship based on practical working conditions, such as subordination and direction, rather than formal contract names. Under new amendments to the PIP Act, inspectors can now unilaterally convert contracts through administrative decisions, bypassing the lengthy court referral process. Financial risks for employers have increased, with fines for failing to rectify improper arrangements doubling from 30,000 PLN to 60,000 PLN per contract. A one-year amnesty period allows employers to avoid these penalties if they voluntarily convert problematic contracts within 12 months of the law’s implementation.

To enhance targeting, the reform enables data exchange with the Social Insurance Institution (ZUS) and the National Revenue Administration (KAS). As of October 2026, PIP has begun sending letters to companies recommending the voluntary conversion of contracts and encouraging self-audits. These entities are identified through data shared by ZUS and KAS. While a specialized algorithm to automate company selection is not expected until January 1, 2027, some economic experts have expressed concern that targeting companies based on database information without explicitly stating specific irregularities may cause uncertainty among employers.
