While residents often treat these areas as private extensions of their gardens, the land frequently belongs to the State Treasury or local government units as part of a public roadway strip.

Under the Act on Public Roads, this strip includes asphalt, ditches, shoulders, embankments, and roadside greenery. Unauthorized activities—such as installing parking spaces, placing decorative stones, or planting and removing trees and shrubs—can result in significant financial penalties, which may amount to ten times the applicable fee.

Legal ownership is determined by land and building registers and geodetic documentation rather than long-term maintenance. Long-term care of the area, such as mowing grass, does not grant ownership rights through adverse possession, as the acquisition of public road lands is legally excluded. To avoid disputes, owners are advised to verify boundaries using cadastral maps or Geoportal.
