Following the 23 August 2026 implementation of new Ministry of Digital Affairs regulations, Poland remains divided over the transcription of foreign same-sex marriages. While the Gdańsk civil registry office successfully processed several registrations, the move has intensified legal and local resistance. In Zakopane, the Civil Registry Office refused a transcription request, prompting an appeal. Mayor Łukasz Filipowicz stated that local legal opinions suggest transcription contradicts Polish law and creates a conflict with Constitutional Tribunal rulings, adding that the municipality intends to uphold the “traditional family model” favored by the region. Legal challenges from Młodzież Wszechpolska and Konfederacja have also been filed with the Provincial Administrative Court, arguing such transcriptions are unconstitutional. Deputy Minister of Digital Affairs Dariusz Standerski maintains there is “no legal basis to refuse these requests” if the marriage document is valid in another EU member state. On 11 September 2026, the Polish Sejm passed legislation aimed at streamlining the execution of judgments from the European Court of Human Rights (ECHR). The law seeks to replace a 2007 regulation with a statutory framework where the Minister of Foreign Affairs designates bodies to implement court rulings. While the law does not establish domestic same-sex marriage, critics like commentator Łukasz Warzecha argue it serves as a mechanism to force the transcription of foreign certificates. In Łowicz, Mayor Mariusz Siewiera noted that local authorities are obligated to process valid applications, clarifying that transcription is a matter of confirming an established foreign marriage rather than performing a new ceremony. The law now moves to the Senate. Administrative updates have since enabled civil registry offices to transcribe certificates for unions legally contracted outside of Poland. This follows a Court of Justice of the European Union ruling determining that member states cannot deny recognition of such marriages if doing so violates the right to free movement. Consequently, the Social Insurance Institution (ZUS) has begun issuing benefits, such as caregiver allowances, to same-sex couples.
