Following the 23 August 2026 implementation of new Ministry of Digital Affairs regulations, Poland remains divided over the transcription of foreign same-sex marriages. The new regulations introduced document templates with neutral categories, such as “woman and woman” and “man and man,” to replace gendered forms. While the Gdańsk civil registry office successfully processed several registrations, the move has intensified legal and local resistance. In Zakopane, the Civil Registry Office refused a transcription request, prompting an appeal. Mayor Łukasz Filipowicz stated that local legal opinions suggest transcription contradicts Polish law and creates a conflict with Constitutional Tribunal rulings, adding that the municipality intends to uphold the “traditional family model” favored by the region. Legal challenges from Młodzież Wszechpolska and Konfederacja have also been filed with the Provincial Administrative Court, arguing such transcriptions are unconstitutional. Deputy Minister of Digital Affairs Dariusz Standerski maintains there is “no legal basis to refuse these requests” if the marriage document is valid in another EU member state. On 11 September 2026, the Polish Sejm passed legislation aimed at streamlining the execution of judgments from the European Court of Human Rights (ECHR). Administrative updates have since enabled civil registry offices to transcribe certificates for unions legally contracted outside of Poland, following a Court of Justice of the European Union ruling regarding the right to free movement. As a result, the Social Insurance Institution (ZUS) has begun issuing benefits, such as caregiver allowances, to same-sex couples. On 24 September 2026, Finance Minister Andrzej Domański signed a general interpretation ensuring that individuals who have transcribed foreign same-sex marriage certificates receive the same tax rights and obligations as other married couples, including joint tax settlements and inheritance benefits. By 6 October 2026, the Ministry of Digital Affairs reported that 516 same-sex marriages performed abroad—comprising 318 marriages between men and 198 between women—had been officially transcribed into the national civil status registry.
