New York is seeking an injunction to halt operations within the state, alongside restitution, forfeiture of illegal gains, and financial penalties that could reach three times the company’s alleged illicit profits. In response to the state's action, Polymarket has filed its own lawsuit in federal court. The company argues that its contracts are federally regulated derivatives overseen by the CFTC and contends that federal law preempts state gambling regulations, claiming the state's actions create an impossible choice between obeying state law and maintaining its federal right to operate.
