Romanian labor and pension rights disputes

Legal and administrative challenges regarding labor benefits and social security entitlements have emerged in Romania.

Initial reports highlighted disputes involving the waste-management firm RETIM, where the Liber RETIM trade union alleged illegal discrimination after the company denied holiday bonuses to employees on fixed-term contracts. Additionally, legal experts noted that public-sector employees with severe disabilities may be entitled to recalculated allowances under Law 153/2017, as current flat-rate payments often fail to account for salary increases.

Subsequent developments focused on the procedures for citizens to rectify pension-related issues. For work periods completed before April 1, 2001, individuals must provide physical documentation, such as workbooks or certificates, to account for records missing from digital databases. If a work history book is lost, the loss must be published in the Official Gazette.

Under Law no. 360/2023, pensioners can challenge decisions from territorial pension houses in court within 45 days of communication. These legal disputes are exempt from judicial stamp tax, allowing pensioners to seek the annulment or modification of decisions through the competent tribunal without paying a fee.
