Shiv Sena election symbol legal dispute

The Supreme Court of India is hearing legal challenges from the Uddhav Balasaheb Thackeray (UBT) faction of the Shiv Sena party regarding the allocation of the party’s ‘bow and arrow’ election symbol. The UBT faction is contesting a February 2023 decision by the Election Commission that awarded the symbol to the Eknath Shinde-led faction.

During proceedings, the court bench, led by Chief Justice Surya Kant, observed that control of a political party rests with the party organization rather than its legislative wing, noting that valid party decisions must prevail even if a majority of legislators disagree. Legal counsel for the UBT faction argued that the dispute questions whether a legislature party can assume control of a political party, suggesting that recent defections have distorted democratic processes.

In response to the ongoing litigation, Aaditya Thackeray expressed confidence in a judicial resolution, stating that the outcome is vital for constitutional democracy and legal predictability. He argued that a robust judicial system is necessary for maintaining investor confidence and industrial growth.
