South Korean political dispute over prosecution reform

Political tension in South Korea has intensified over the authority and reform of the prosecution service. Initial debates focused on the potential withdrawal of prosecutions related to President Lee Jae-myung and the scope of the Special Prosecutor Act. While lawmakers agreed on investigating allegations of fabricated prosecutions, they remained divided on whether a special prosecutor should have the power to withdraw existing indictments. During this period, Justice Minister nominee Kim Seung-won indicated he would not directly command the withdrawal of prosecutions through the Prosecutor General.

Legislative disputes subsequently expanded to include the ‘Prosecutor Dismissal Act’ and the Major Crimes Investigation Agency (MCIA) Act. The Democratic Party has sought to expand disciplinary measures, including dismissal, for prosecutors. In opposition, the People Power Party has argued for stronger job security and independence for prosecutors. Additionally, the People Power Party criticized amendments to the MCIA Act that allow prosecutors to request supplementary investigations for seven major crime categories, labeling the move a ‘patchwork amendment’ and calling for the restoration of original investigative rights.
