The Spanish government is revising its royal decree to regulate data centers, softening certain environmental requirements following criticism from the technology and energy sectors. sectors and a report from the National Commission on Markets and Competition (CNMC). The updated regulations, which have been sent to the Council of State, aim to ensure that only the most sustainable projects proceed while preventing high electricity consumption from driving up consumer prices. Key changes in the revised decree include providing more time for facilities to meet renewable energy consumption obligations. Additionally, narrowing the scope of the regulations has been narrowed; the updated version applies to apply only to large-scale data centers with a capacity exceeding 10 megawatts, whereas the initial draft applied to all facilities over 1 megawatt. To provide more flexibility, the government has introduced a five-year moratorium for facilities that join the automatic power reduction system (SRAP). These facilities would only need to cover 60% of their consumption with green energy during certain periods until 2028, rather than the target of 80%. In exchange for this flexibility, the system operator, Red Eléctrica, will have the authority to order these centers to reduce their load to zero or disconnect them entirely during grid contingencies without compensation. This regulatory shift follows concerns regarding the massive influx of data center projects in Spain and the potential impact on the national electrical grid. The government maintains the authority to disconnect facilities that fail to comply with established green standards. Officials intend to approve the decree before the upcoming general elections on November 29 to avoid the legal limitations of a caretaker government.
