Spain data centre renewable energy regulations

Overview

The Spanish government is drafting new regulations to manage the rising electricity demand caused by artificial intelligence and cloud infrastructure. The proposal targets data centres with at least 1 MW of grid-access capacity, requiring them to match at least 80% of their electricity consumption with additional renewable generation on an hourly basis.

To prevent competition for existing clean energy, the mandate suggests that operators use self-consumption or power purchase agreements with a minimum 10-year duration. Non-compliance may lead to penalties such as the loss of grid-access rights or network and system-charge surcharges of up to 500%. The regulations also aim to address water efficiency, power usage effectiveness, and digital sovereignty by requiring infrastructure operators to be established within the European Union.
