The Ingreso Mínimo Vital (IMV) benefit in Spain has been the subject of legal rulings and administrative clarifications regarding eligibility and repayment obligations.

In Galicia, the High Court of Justice has issued rulings on repayment demands. In one instance, the court protected a widow from returning over 2,500 euros, citing the “Cakarevic” doctrine which prevents individuals from being penalized for errors caused solely by public authorities, such as incorrect fiscal data from the Tax Agency. Conversely, the court upheld a demand for 4,775 euros against a woman who provided incomplete residency documentation, which led to incorrect benefit calculations.

Broadening the scope to national administration, the National Institute of Social Security (INSS) clarified that adults over 30 living with parents may qualify for the benefit if they meet economic vulnerability requirements. As of July, the program supports approximately 2.68 million people. However, officials warned that changes in wealth, such as receiving an inheritance, can increase computable household resources beyond permitted thresholds and trigger requirements to repay previously received funds.
