Spanish judicial rulings on labor rights violations
Overview
Spanish courts have issued rulings nullifying employee dismissals in cases where fundamental labor rights were found to have been violated.
The High Court of Justice of Aragon declared a dismissal null for a municipal worker in Peralta de Alcofea, finding that the elimination of the position was linked to the worker exercising rights regarding work-life balance and family reconciliation. The court noted a close temporal proximity between the worker’s request for reduced hours and the decision to outsource the service.
In a separate case, the Supreme Court confirmed the nullity of a dismissal involving a veterinary clinic employee who refused to work Saturdays following a schedule change. The court ruled the termination was a reprisal that violated the principle of indemnity, requiring the company to reinstate the worker and pay damages.
Expanding on these protections, the Supreme Court recently declared the dismissal of a marketing manager at an Ávila-based 3D printing company null and void. The court found the company terminated the employee because she was a victim of gender-based violence, viewing her legal situation as an “inconvenience.” The ruling requires reinstatement, payment of outstanding wages, and 10,000 euros in compensation.
Additionally, the Supreme Court annulled a requirement by the Xunta de Galicia that mandated permanent contract staff commit to becoming civil servants to access professional grade progression and performance bonuses. This decision followed a challenge by the CIG union regarding the exclusion of approximately 1,000 employees from career supplements.
