Spanish police misconduct legal proceedings

Overview

Legal proceedings have emerged regarding allegations of misconduct by police officers in different Spanish regions.

In Alicante, prosecutors are seeking two years and six months of prison and a three year disqualification for two Benidorm officers. The officers are accused of hate crimes for allegedly humiliating and disparaging a transgender woman during a state of exception in May 2020. The prosecution argues the officers acted with discriminatory motivation, while the defense has requested acquittal.

In Granada, a private prosecution is seeking prison sentences of up to 12.5 years for the former head of the Local Police and seven other officers. The group is accused of unauthorized access to the VioGén platform, a system used to monitor victims of gender based violence. The prosecution alleges 47 unauthorized consultations were made between August 2023 and April 2024. While the prosecution seeks prison time and disqualification from public office, the Public Prosecutor’s Office has requested the case be archived, maintaining the facts do not constitute a criminal offense.
