Suicide decriminalization efforts in Nigeria and Malawi

Nigeria and Malawi are navigating legislative and social transitions to decriminalize attempted suicide and prioritize mental health care over punitive measures.

In Nigeria, the Federal Executive Council has officially approved the decriminalization of attempted suicide. This marks a significant shift from the previous legal framework under Section 327 of the Criminal Code Act and Section 231 of the Penal Code, which classified attempted suicide as a misdemeanor punishable by fines or up to one year in prison. This approval follows the development of a Government White Paper by a National Task Force, intended to move the matter to the National Assembly to formally amend the Criminal Code Act.

Health advocates and organizations, such as Nigerian Mental Health, have welcomed the reform, noting that the fear of arrest or public exposure often prevents distressed individuals from seeking support. Psychiatrist Professor Taiwo Obindo noted that while many attempts are linked to conditions like depression, others may be driven by impulsivity, poverty, or chronic illness. He emphasized that decriminalization will allow for better access to mental health assessments and psychosocial support, treating attempts as a public health concern rather than a criminal offense.

In Malawi, a legal conflict persists between the recently activated Mental Health Act, which treats mental distress as a health emergency, and Section 229 of the Penal Code, which still allows for up to two years of imprisonment. Activists and experts continue to call for the repeal of these conflicting laws to ensure survivors receive support rather than being booked by police.
