Swedish rental market policy and negotiation disputes

Disputes and policy developments are emerging within the Swedish rental market regarding negotiation processes and tenant requirements.

The Swedish Tenants Association (Hyresgästföreningen) has called for the abolition of the independent arbitrator system used in rental negotiations. Association president Marie Linder claims property owners are overusing the system to bypass local negotiations, which she argues leads to higher rents. Data indicates that while 15 percent of public housing negotiations proceeded to dispute resolution in 2026, over 70 percent of negotiations represented by the property owners association, Fastighetsägarna, utilized an arbitrator. Fastighetsägarna has rejected the demand for abolition, suggesting instead that arbitrators be granted more power to make directly applicable decisions.

In a separate development, Sveriges Allmännytta and Fastighetsägarna released new guidance to help landlords establish transparent rental policies and access requirements, such as income assessments, while complying with anti-discrimination laws. Additionally, discussions have surfaced regarding the economic impact of tenant maintenance obligations, noting that failures by tenants to perform basic upkeep lead to increased repair and emergency costs for landlords.
