Turkey consumer protection legal developments
Overview
Under Turkey’s Law No. 6502 on Consumer Protection, buyers of defective or non-conforming goods are entitled to several remedies, including contract termination with a full refund, product replacement, price reduction, or free repair.
Following legal challenges, the Council of State (Danıştay) overturned a Ministry of Trade regulation that had restricted the right of withdrawal for specific product categories. This ruling restores the ability for consumers to return items such as motorcycles, smartwatches, mobile phones, tablets, and computers. Mahmut Şahin, President of the Consumers Union, noted that consumers will not be charged for shipping costs during the return process. The legal challenge successfully removed provisions that critics argued were designed to favor capital interests over consumer needs, citing Article 48 of Law No. 6502 and Article 124 of the Constitution.
