Uganda mandatory bail rulings for social media charges

In Uganda, the Buganda Road Chief Magistrate’s Court has granted mandatory bail to individuals facing charges related to social media content.

Lawyer Male Mabirizi was granted bail after spending over 60 days on remand. He faces charges under the Computer Misuse Act, including malicious information and hate speech, following alleged TikTok statements targeting Chief Justice Flavian Zeija and Court of Appeal Justice Musa Ssekaana. The court ruled that it had no discretion to withhold bail once the statutory threshold for remand was exceeded.

Following this, TikTok content creator Ibrahim Musana, known as ‘Pressure 24/7’, was also granted mandatory bail after approximately five months on remand. Musana faces charges of hate speech and unlawful processing of personal data under the Data Protection and Privacy Act and the Computer Misuse Act. The prosecution alleges he published content intended to ridicule the Chief of Defence Forces, Gen Muhoozi Kainerugaba. The court noted that the delays in Musana’s trial were not caused by the accused.
