UK housing developers' Section 106 disputes

In late July, a developer in Cornwall, Wainhomes South West, asked to remove or cut a £348,798 Section 106 contribution that funded a new primary school, health and transport facilities for a 58‑home scheme. The same period saw the Berkeley Group promote a private‑school‑fee incentive for buyers of luxury homes in north London, highlighting market stagnation.

By early August, the issue had attracted political scrutiny. MP Ben Maguire cited the Wainhomes case in his "Infrastructure First" bill, urging Cornwall Council to retain the funding. Simultaneously, residents and councillors in Swindon complained that developers Redrow and Vistry left flood‑management, park safety and landscaping works unfinished, creating a near £200,000 shortfall. Calls grew for stronger redress mechanisms for homebuyers, signalling broader backlash against developers seeking to sidestep infrastructure obligations.
